O R D E R
This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to act upon the representation made by the petitioner on 23.09.2024 wherein the petitioner is seeking for removal of the names of the respondents 7 to 21 from the patta that was earlier exclusively granted in the name of the petitioner with respect to the subject property.
2. Heard Mr.J.Hari Krishna, learned counsel for the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for respondents 1 to 6.
3. The main grievance expressed by the learned counsel for the petitioner is that the patta originally stood in the name of the petitioner. The petitioner filed a suit in O.S.No.32 of 1997 before the District Munsif Court, Denkanikottai seeking for the relief of declaration and permanent injunction. 3/6
When the suit was pending, the private respondents managed to submit an application before the fourth respondent and their names were also added in the patta and fresh patta has been issued in Patta Nos.792 and 2370. Aggrieved by the same, the petitioner gave a complaint before the first respondent on the grievance day. The same was forwarded to the fourth respondent and thereafter, there was absolutely no progress. Aggrieved by the same, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and considering the grievance of the petitioner, there shall be a direction to the petitioner to submit an independent application/representation to the third respondent seeking for removal of the names of the private respondents from the patta. On receipt of the same, the third respondent shall deal with the representation after affording opportunity to all the parties concerned and pass orders on its own merits and in accordance with law within a period of eight (8) weeks from the date of receipt of the fresh representation from the petitioner. 4/6
