ORDER

This Writ Petition has been filed in the nature of a Certiorarified Mandamus seeking a direction against the respondents to disburse the retirement benefits along with remaining salary of a sum of Rs.6,67,721/- together with interest from 11.01.2009 till date, considering the representation dated 26.11.2024.

In the affidavit filed in support of this writ petition, it had been stated that the petitioner was worked as Secretary at Vellithiruppur Primary Agricultural Co-operative Society from 01.09.1975 till 28.11.2000. Thereafter, another person was appointed as Secretary. The petitioner was then reinstated as senior clerk from 29.11.2000 till 10.10.2009. He voluntarily retired from service on 28.11.2009. It is contended that the salary had not been paid to the petitioner and further retirement benefits had been withheld by the respondents.

In this connection, the learned Government Advocate for the respondent had forwarded a statement relating to the amounts paid to the petitioner herein and had stated that as on 12.12.2017, a sum of Rs.2,88,572/- was due and payable to the petitioner. Further document had been produced on behalf of the respondents particularly a letter dated 13.12.2017 given by the petitioner herein, wherein he had stated that he received Rs.2,88,572/- in full settlement of all his claims. This amount had also been paid to the petitioner by a cheque dated 13.12.2017 drawn on the Erode District Central Cooperative Bank Limited in Cheque No.449543. There has also been acknowledged by the petitioner by affixing his signature in the revenue stamp.

4. It is thus seen that the entire amount had been paid by the respondents and the same had also been acknowledged by the petitioner on 13.12.2017. In the present writ petition, he claims that amount for the year 2009 has not been paid, but that would be the amount which was encompassed in the letter given on 13.12.2017 and he had not raised any issue that for the year 2009, he had not been paid any amount. The documents produced by the respondents show

that the petitioner had been paid with the amounts due and payable to him and he had also received the same.

5. The Writ Petition therefore stands dismissed. No costs. If the petitioner had any further grievances, the petitioner may take appropriate action in the manner known to law.
