M/S.Lakshmi Estates, v. M/S. Sivams Foundations,

2022-04-12Honourable Mr Justice M. Sundar3 pages

in O.P.No.703 of 2019 M.SUNDAR, J., Mr.Abhinav Parthasarathy, learned counsel of M/s.G.R. Associates (Law Firm) for the applicants and Mr.T.S.Baskaran, learned counsel for fourth respondent are before this Court.

2. Aforementioned two counsel submit in one voice that captioned application is under Section 29A(4) of 'The Arbitration and Conciliation Act, 1996 (Act No.26 of 1996)' [hereinafter 'A and C Act' for the sake of convenience and clarity] with a prayer for extension of time to complete the arbitration. Both learned counsel further submit in one voice that reasons beyond the control of all concerned including 'Arbitral Tribunal' ['AT'] has necessitated the presentation of captioned application in this Court with an innocuous prayer for extension of time for AT to complete the arbitral proceedings and to make an arbitral Award. Though obvious it is made clear that owing to this order, the snapping of the mandate of the learned Arbitrator is resuscitated and the mandate will continue as the prayer for extension of time qua arbitral proceedings is being acceded to. 1/3

Learned Arbitrator is requested to complete the arbitration proceedings as expeditiously as possible and in any event on or before 06.10.2022.

3. Captioned application ordered in the aforesaid manner. There shall be no order as to costs.
