ORDER
The present miscellaneous petition is filed seeking an order of interim direction to the respondents to permit the petitioner to continue in the post of Assistant Treasury Officer, Keezhvelur, Nagapattinam District lying vacant, pending disposal of W.P.No.33753 of 2025.
2. Learned senior counsel for the petitioner would submit that when the petitioner was working as Superintendent, she was entitled to choose two way of promotion viz., Assistant Accounts officer and Assistant Treasury Officer. Thus, the petitioner opted the promotion as Assistant Treasury officer and continued to work as such till date. The post of Assistant Treasury Officer remains to be feeder post for promotion to the post of Additional Treasury Officer and Accounts Officer. The post of Accounts officer coming under State Service to be filled up by promotion from the post of Assistant Accounts Officer (State Service) and by recruitment by transfer from the post of Assistant
Treasury Officer (Subordinate Service). Thereby, the petitioner opted the promotion to the post of Additional Treasury Officer and relinquished her promotion to the post of Accounts Officer in the year 2024. However, without considering the same, the respondents included the petitioner's name in the panel for promotion to the post of Accounts Officer. Challenging the same, the present writ petition is filed.
3. When the matter was taken up for hearing on earlier occasion, this Court granted an interim direction to the respondents not to precipitate the matter. But, the respondents have prevented the petitioner from working as Assistant Treasury Officer.
4. In view of the above, there shall be a direction to the respondents to allow the petitioner to function as Assistant Treasury Officer, Keezhvelur, Nagapattinam District and the same is subject to the result of this writ petition. Accordingly, this writ miscellaneous petition is ordered, as prayed for. 18-02-2026 VM
