This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 28.09.2024, seeking bail in RR No.45 of 2024 registered for the offence under Sections 8(c), 20(b)(ii)(c),28 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 1/4
2. The case of the prosecution is that the petitioner along with the other accused was found in illegal possession of 52 .700kgs of ganja. Hence the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent; that he has been falsely implicated in this case and since further custody of the petitioner is not required for the purpose of investigation and he sought for grant of bail.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the contraband seized is of commercial quantity; that investigation is pending and hence, opposed for grant of bail to the petitioner.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

6. Considering the nature of allegation; that the contraband seized is of commercial quantity; that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
