ORDER
This Writ Petition has been filed for a declaration, to declare the order of suspension passed by the first Respondent in G.O.(2D) No.78, Municipal Administration and Water Supply (MC6) Department, dated 26.06.2025 as illegal, arbitrary and non-est in law and consequently, to declare the petitioner is deemed to have retired from service on 30.06.2025 and to direct the respondents to disburse all the eligible terminal service and monetary benefits to the petitioner.
2. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.
3. When the matter is taken up for hearing, the learned Senior counsel for the petitioner submitted that the order issued by the first Respondent in G.O. (2D) No.78, Municipal Administration and Water Supply (MC6) Department, dated 26.06.2025 was subsequently withdrawn by the respondents vide proceedings dated 24.12.2025 and hence, nothing survives for further adjudication in regard to retirement of the petitioner, however he prayed this Court that there may be a direction to the respondents to conclude the disciplinary proceedings and to disburse all the terminal and monetary benefits to the petitioner, within a reasonable time.

The learned Additional Government Pleader has also produced the report sent by the Joint Commissioner of the Municipal Corporation in withdrawal of the proceedings of the first respondent dated 26.06.2025 as against the petitioner today and further submitted that the disbursement of all the eligible terminal service and monetary benefits to the petitioner is under consideration as per the Government Letter No.7399/AV.3/2025, Human Resources Department, dated 09.10.2025.
4. The submissions of the learned Additional Government Pleader, is hereby recorded. However, in view of the submission made by the learned Senior counsel for the petitioner, the respondent concerned is directed to
conclude the disciplinary proceedings as against the petitioner as per Rule 9(2) (a) of the Tamil Nadu Pension Rules within a period of six weeks from the date of receipt of a copy of this order and to settle the eligible terminal benefits to the petitioner in terms of the order passed by the authorities.
5. With the above directions, this Writ Petition is closed. Consequently, connected Miscellaneous Petitions are closed. There shall be no order as to costs.
