This petition is not maintainable since if the modification petition is allowed by the Court, the same Court cannot alter or review the earlier order passed in Crl. M.P. No.18181 of 2023 dated 02.01.2024, in which this Court, as a last chance, had given an opportunity to deposit 20% of the compensation amount fixed by the Trial Court within a period of four weeks from the date of order.

2. Such bar under Section 362 of Cr.P.C. will apply even for proceedings under Section 482 of Cr.P.C.. Useful reference can be made to the judgment of the Apex Court reported in 2020 (1) LW Crl 628.

3. In view of the above, this Criminal Miscellaneous Petition is dismissed. However, this Court is inclined to extend the time for a period of 4 weeks from today. It is made clear that no further extension will be granted in future. 22.02.2024 mjs https://www.mhc.tn.gov.in/judis
