Respondent in both W.Ps W.P.No.4288 of 2004 filed under Article 226 of the Constitution of India praying for issue of Writ of certiorarified mandamus calling for the records relating to the proceedings made in Ref.No.ACW/Per-2/2004 dated 07.02.2004 issued by the respondent and quash the same and direct the respondent to reinstate the petitioner in service with all attendant benefits.

W.P.No.7414 of 2004 filed under Article 226 of the Constitution of India praying for issue of Writ of certiorarified mandamus calling for the records relating to the proceedings made in Ref.No.ACW/PL-2/2004 dated 09.03.2004 issued by the respondent and quash the same so far it relates to exempting him from attending the duty and consequently forbear the respondent from preventing the petitioner from attending the duty.

For Petitioner : Mr.G.Ethirajulu (in both W.Ps.) For Respondent : A.Sivaji (in both W.Ps.) C O M M O N O R D E R Mr.G.Ethirajulu, learned counsel appearing for the petitioner submitted that the Writ Petitions have been filed against the order of suspension and that the petitioner had retired from service on 31.07.2019, hence, nothing survives for adjudication in the Writ Petitions. submitted that he would contest the criminal proceedings in accordance with law. The learned counsel also made an endorsement to that effect.

2.In view of the same, the Writ Petitions are dismissed as infructuous. It is open to the petitioner to contest the criminal proceedings in accordance with law. No costs.
