JUDGMENT

Challenging the concurrent findings of the courts below rendered in A.S.No. 101 of 2022 on the file of VII Addl. City Civil Court, Chennai confirming the findings rendered in O.S.No.2529 of 2013 on the file of III Asst. City Civil Court, Chennai, the appellants/defendants have preferred this Second Appeal.

2. Today, when the matter taken up for hearing, the learned counsel for petitioners filed a Joint Compromise Memo for arriving settlement between the parties. In view of compromise, this Second Appeal is disposed of. Both parties are directed to comply the terms of Joint Compromise Memo. On withdrawal of the deposit amount from the trial court, the appellants are directed to get back their original documents and if any such application is filed, the trial court is directed to return the original documents within a period of two weeks. Since the matter is settled out of court, the Registry is directed to refund the court fee, which was paid by the appellants in S.A.No. 159 of 2024. Furthermore, the SubRegistrar, Ambattur, is directed to cancel the Memorandum of deposit of title

deed dated 03.06.2009 vide document No.3274/2009 on payment of entire amount. The Joint Compromise Memo shall form part and parcel of this judgment. No costs. Consequently, the connected Miscellaneous Petitions are closed.
