Writ Petition is filed under Article 226 of the Constitution of India, seeking issuance of a writ of certiorarified mandamus, to call for the records in S.R.124/2002, dated 29.4.2002 on the file of the first respondent and quash the same and direct the respondents 1 and 3 to release the registered document bearing Document No.347 of 2000 forthwith. Heard Mr.S.K.Rakhunathan, learned counsel for the petitioner and Mr.P.P.Purushothaman, learned Government Advocate for the respondents.
2. This writ petition has been filed challenging the order https://hcservices.ecourts.gov.in/hcservices/
dated 29.4.2002 passed by the first respondent Special Deputy Collector (Stamps), Coimbatore, whereby, the petitioner was directed to remit the deficit stamp duty of Rs.41,170/-, for releasing the document.
3. It is represented by the learned Government Advocate that under the Samadhan Scheme, the petitioner remitted a sum of Rs.27,450/-, towards deficit stamp duty and another sum of Rs.2,290/-, for registration charges and thereafter, the document was released in favour of the petitioner.
4. In the light of the above submission, the prayer sought for in this writ petition has become infructuous. Accordingly, the writ petition is dismissed as having become infructuous. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
