Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified mandamus calling for the records relating to the notice dated 25.02.2004 issued by the respondent, quash the same and direct the respondent to issue and accept the tender schedule to those contractors including the petitioner who have remitted the amounts towards tender forum and tender deposit before 2 P.M. on 24.02.2004 as per the tender notice dated 17.2.2004 and open the tender on the day fixed by this Hon'ble Court and proceed further in accordance with law without issuing fresh tender notice and tender schedule to other new persons.

The learned counsel appearing for the petitioner made a submission that the prayer in this writ petition has already became infructuous and he had also made an endorsement to that effect.
