The relief sought by the petitioner in this writ petition is to direct the respondents to call for the records in proceedings in letter No.Nil dated 31.03.2008 passed by the 3rd respondent and quash the same and consequently direct the respondents to allow the petitioner to immediately rejoin the duty as a Clerk in the 3rd respondent Panchayat with all concomitant benefits.
2. Today, when the matter was taken up for hearing, learned counsel appearing for the fourth respondent submitted an additional counter affidavit dated 28.06.2022, stating that the relief sought in this writ petition has Page No.2 of 5
become infructous since the petitioner was suspended from service as early as on 31.03.2008 and subsequently, dismissed from service on 31.03.2009. However, the said writ petition was filed on 28.09.2010. Therefore, the learned counsel appearing for the fourth respondent prayed that this Court may be pleased to dismiss the above writ petition as infructuous.
3. In view of the above submission made by the learned counsel for the fourth respondent, nothing survives in this writ petition. Accordingly, this writ petition is dismissed as infructuous. No costs. 04.07.2022 Index :
