On representation of the counsel for both sides, this case is taken up for settlement before the Lok Adalat. Both parties are present. Mr.S.Akilan, Manager for National Insurance Company Limited and the learned counsel for the Appellant Mr.D.Baskaran and the learned counsel for the Respondents / Caveators 1 to 5 Mr.Rajesh are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.30,02,400/- with interest at 7.5% per annum from the date of filing i.e., 30.09.2011 till the date of realization and costs as compensation. Aggrieved by the award of the Tribunal, the appellant / Insurance Company had preferred the present appeal.

2. After due deliberation and consultation, both the parties have agreed to modify the award to a sum of Rs.34,50,000/- (Rupees Thirty Four Lakhs Fifty Thousand only) in full quit as compensation.

3. The appellant / Insurance Company is directed to deposit the above said modified award amount, after deducting the amount already deposited if any, within a period of six weeks from the date of receipt of a copy of this order.

4. On such deposit, the first respondent is permitted to withdraw a sum of Rs.20,00,000/- (Rupees Twenty Lakhs only) and the second respondent is permitted to withdraw a sum of Rs.5,00,000/- (Rupees Five Lakhs only) and the third and fourth respondents each are permitted to withdraw a sum of Rs.4,00,000/- and the fifth respondent is permitted to withdraw a sum of Rs.1,50,000/- in full quit without filing any formal petition before the Tribunal. Award is passed accordingly.

4. The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. Consequently, connected Miscellaneous Petition is closed, if any.
