ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.07.2025, for the offence punishable under Sections 8(c), 20(b)(ii)(c) of NDPS Act, 1985 in Crime No. 109 of 2025, on the file of the respondent, seeks bail.

2. This is the 3rd bail petition. This Court has earlier dismissed bail petitions of the petitioner twice in Crl.O.P.No.34330 of 2025 dated 16.12.2025 on the following reasons:

"5. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.OP.No.31266 of 2025 dated 17.11.2025 on the following reasons: "5. I have gone through the records, and it is seen that though the learned counsel for the petitioner stated that the petitioner was arrested at Oragadam and brought to the police station along with three other persons, and that while the other three persons were let off, the petitioner alone was implicated in this case, but the petitioner has not produced any material to support his version. Further, the rigors of Section 37 of the NDPS Act apply to the petitioner, and no ground was made out to satisfy the requirement under Section 37 of the NDPS Act. Hence, this Court is not inclined to grant bail to the petitioner."

3. The learned counsel appearing for the petitioner submitted that now the investigation has been concluded and the final report also filed. Hence, he prayed for grant of bail to the petitioner.

4. However, the petitioner has not made out grounds to satisfy Section 37 of the NDPS Act, hence, this Court is not inclined to revisit the earlier order, this petition is liable to be dismissed. Accordingly, this Criminal Original Petition is dismissed.
