J U D G M E N T
This Civil Miscellaneous Appeal has been preferred as against the award of Rs. 15,000/- passed by the Motor Accidents Claims Tribunal (Chief Judicial Magistrate), Erode, in favour of the 1st respondent herein, for the injuries sustained by her, in the accident, which occurred on 02.04.2010.

Heard Mr.S.V. Vasanthakumar, learned counsel appearing for the appellant and Mr. Lakshmipathi, learned counsel for the 1st respondent.

Though it is contended by the learned counsel for the appellant that the registration number of the Transport Corporation bus was not found reflected in the FIR, but, in the absence of any https://hcservices.ecourts.gov.in/hcservices/
evidence adduced, on behalf of the appellant, rebutting the evidence of P.W.1, who stated about the registration number of the bus and the manner of accident, the Tribunal was right in believing the evidence of P.W.1 and finding that the accident involved the vehicle belonging to the appellant Transport Corporation and that the driver of the said vehicle was responsible for the accident. Hence, the said finding cannot be found fault with.

As far as the quantum of compensation awarded by the Tribunal is concerned, only a sum of Rs.15,000/- was awarded as compensation to the 1st respondent, which is very negligible. The Transport Corporation ought not to have filed an appeal and in fact, the appeal is liable to be dismissed with heavy costs. However, due to judicial restraint, this Court is not imposing any cost on the appellant.

In the result, the Civil Miscellaneous Appeal is dismissed confirming the award passed by the Tribunal. No costs. Connected M.P. is closed.
