ORDER

This revision petition has been filed seeking a direction to the learned District Munsif, Tiruppur, for early disposal of the suit in O.S.NO.13 of 2019 preferably within the time of the frame to be fixed by this court.

2. Considering the limited nature of the relief sought for in this revision petition and the other facts and circumstances of the case, this court is of the view that no notice is necessary as no prejudice would cause to the other side if a direction is issued to the court below for early disposal of the original suit.

3. I have heard the learned counsel for the petitioner and also perused the records carefully.

4. The learned counsel for the petitioner submitted that the petitioner is 87 years of old and she has filed the suit for a simple mandatory injunction for the return of a title deed. According to the learned counsel, issues have been framed and the case is posted today for trial.

5. In view of the limited nature of the relief sought for and on considering the old age of petitioner and also on considering the fact that issues have already been framed and the case is posted for trial, without going into the merits of the case, this court directs the learned District Munsif, Tiruppur, to proceed with the trial of the suit in O.S.No.13 of 2019 and dispose of the same within a period of three months from the date of receipt of a copy of this order.
