2. In the affidavit filed in support of the said application it had been stated that the documents which were required for preparing the written statement were not available. There was a delay in collecting the required documents and there after in preparing the written statement. It has been however stated that the written statement had been filed within the outer period of 120 days as prescribed in the Commercial Courts Act, 2015.

3. In view of the fact that it would only be appropriate that the issues raised in the plaint are determined on merits and also on hearing the learned counsel for the plaintiff, this application is allowed and the delay is condoned.
