This petition has been filed to condone the delay of 38 days in filing the above appeal.

Mr.D.Senthil Kumar, learned counsel takes notice for the first and second respondents.

Though notice was served to the third respondent, he has not appeared before this Court either in person or through Advocate. 4.

The learned counsel appearing for the first and second respondents fairly submits that he has no serious objection to the delay of 38 days being condoned.

In view of the above submission and having been satisfied with the reasons stated in affidavit filed in support of this petition, the delay of 38 days is condoned.

The Registry is directed to number the appeal, if it is otherwise in order and post the same for admission. The Registry is further directed to print the name of the learned counsel for the first and second respondents in the cause list at the time of admission.
