PRAYER :

Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent ending with impugned notice dated 22.09.2010 in No.49721/I-I/2007 and quash the same and consequently directing the first respondent to dispose of the statutory appeal dated 05.10.2007 filed by the petitioner in Appeal No.49721/I-I/2007 as per the provisions of Tamil Nadu Societies Registration Act by not entertaining the second respondent in any manner who has no locus standi in the said appeal.

ORDER

This writ petition has been filed to quash the notice dated 22.09.2010 issued by the first respondent and consequently direct the first respondent to dispose of the Appeal, dated 05.10.2007 filed by the petitioner as per the provisions of Tamil Nadu Societies Registration Act without entertaining the second respondent in any manner.

2. The learned counsel for the petitioner submitted that the petitioner preferred an appeal before the first respondent / Appellate Authority and the same is pending without any consideration. The learned counsel further submitted that it would suffice, if the 1st respondent is directed to dispose of the appeal filed by the petitioner, for which, the learned counsel appearing for the respective respondents have no serious objection.

3. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court directs the first respondent / Appellate Authority to dispose of the Appeal, dated 05.10.2007, on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioner as well as any of the interested parties, within a period of six weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
