This revision has been filed to call for the records in Crl.M.P.No.1191 of 2018 passed by the learned Judicial Magistrate II, Cuddalore and to set aside the order dated 25.07.2018 and to take the petitioner's complaint on file and proceed the same in accordance with law.
2.The case of the petitioner that the revision petitioner filed a private complaint in Crl.M.P.No.1191 of 2018 before the Court below under Section 200 Crl.P.C., for taking action against the respondents for the offence Sections 81, 82(d) and 166, 167, 198, 199, 201, 218, 219, 467, 471 and 474 IPC., on the ground that without having right over the property, the respondents/accused registered a sale deed in Survey No.343/4 to third parties. According to the petitioner, the property in dispute is actually belonging to the petitioner for which, the patta is stands in the name of the petitioner's father. He would further submit that since the land stands in the name of petitioner's father, in order to grab the property, the fourth respondent father filed a suit in O.S.No.553 of 2017 before the Subordinate Court, Cuddalore. Aggrieved by the registration of the sale deed by the fourth respondent, the impugned complaint filed before the Court below.
3. Having gone through the entire records, I do not find any infirmity or irregularity in the order passed by the Court below warranting interference by this Court. However, liberty is given to the petitioner to work out his remedy before the Civil Court where the Civil Suit is pending.
Accordingly, this revision is dismissed.
