Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent to receive the application filed by the petitioner for reopening the evidence and pass orders on the same in accordance with law by affording an opportunity to the petitioner to let in evidence in W.C.No.187 of 1999. The learned counsel appearing for the petitioner would submit that, long time there has been no instruction from the petitioner despite best efforts in this regard by the counsel for the petitioner. Therefore, the learned counsel would submit that, as the same may be recorded, accordingly, it may be disposed of.

2.However, the learned counsel appearing for the fourth respondent on instruction would submit that, the issue raised in this writ petition has become infructuous.

3.Be that as it may, in view of the no instructions reported by the learned counsel appearing for the petitioner, recording the same, this Writ Petition is dismissed for want of prosecution. No costs. Consequently, connected miscellaneous petition is closed.
