O R D E R

The subject matter of challenge in this writ petition is the order passed by the 2nd respondent dated 22.01.2004, wherein, one Syed Meeran Khadri was appointed as a Muthawalli of the Dargah and his period was fixed as three years from the date of the order with usual terms and conditions. It is seen from the terms and conditions that on expiry of the three years, the tenure of office will automatically cease.

2.The learned Standing Counsel appearing on behalf of the respondents 2 to 4 submitted that the person, who was appointed as a Muthawalli died and the period has also come to an end and therefore, nothing survives for consideration in this writ petition.

3.In the considered view of this Court, nothing survives for consideration in this writ petition since the person, who was appointed as a Muthawalli died and the period has also come to an end.
