Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, Since the Orders issued in G.O.(2D) No.3, Co-operation, Food and Consumer Protection Department dated 10.01.2025 has not been honoured by presenting the Bill in the Pay and Accounts Office, Secretariat, Chennai 600009 for the last 1 year. Hence it is humbly prayed that this Honble Court may be pleased to direct the respondents to settle the amount to late Tmt. K.Shivalakshmi, formerly Section Officer, Cooperation, Food and Consumer Protection Department,within a reasonable period as may be fixed by this Honble Court, along with interest for the period from 01.4.2013 till the date of settlement.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to settle the amount of late Tmt. K.Shivalakshmi, formerly Section Officer, Cooperation, Food and Consumer Protection Department to the petitioner, within a reasonable period as fixed by this Court, along with interest for the period from 01.4.2013 till the date of settlement, as per the Orders issued in G.O.(2D) No.3, Co-operation, Food and Consumer Protection Department dated 10.01.2025.

2. Heard the learned counsels appearing on either side.

3. It is the case of the petitioner that her deceased wife had worked as Section Officer in the fourth respondent Department and retired from service on 30.04.2013. After filing of several litigations, the petitioner's deceased wife obtained orders from this Court for sanction of her monetary benefits by the respondents and pursuant to which, the fourth respondent issued orders in G.O. (2D) No.3, Co-operation, Food and Consumer Protection Department, dated 10.01.2025 after lapse of 13 years, however the said G.O. was not implemented by the fourth respondent even after one year. Hence, the present Writ Petition.

4. The learned counsel for the petitioner submitted that there may be a direction to the respondents to settle the monetary benefits to the petitioner has sanctioned to the petitioner's deceased wife through G.O.(2D) No.3, dated 10.01.2025, within a reasonable time.

5. Per contra, the learned Additional Government Pleader submitted that G.O.(2D) No.3 dated 10.01.2025, sanctioning monetary benefits to the deceased petitioner's wife will be implemented and the amount will be disbursed to the petitioner, within a period of six weeks.

6. In view of the submissions of the learned Additional Government Pleader, there shall be a direction to the fourth respondent to implement the G.O.(2D) No.3 dated 10.01.2025 and to pay the monetary benefits sanctioned to the deceased K.Shivalakshmi to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

7. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
