This writ petition has been filed to direct the respondents to survey the petitioner's land bearing S.No.1037/1 situated in Chinnakalrayan hills, Pethanayakanpalayam Taluk, Salem District, measuring an extent of 1.63.5 hectares, considering the representation preferred by the petitioner, dated 15/2/2022.
2. By consent, the writ petition is taken up for final disposal.
3. Brief facts which are necessary for the disposal of the writ petition are as follows:- Petitioner Trust is a Public Charitable Trust, purchased a land bearing S.No.1037/1 situated at Chinnakalrayan hills, Pethanayakan Palayam Taluk, Salem District, measuring an extent of 1.63.5 hectares and the same was registered, vide Document No.213/1983, in the office of SRO, Pethanayakan Palayam. Since the petitioner had decided to use the land for the development of educational Institutions, approached the respondents, on 15/2/2022, to survey the land and paid Rs.800/- to survey. Since the respondents had not taken steps to survey the land of the petitioner Trust, Page No:2/4
the petitioner has come forward with the instant writ petition praying for the relief as stated therein.
4. Heard Mr.M.Venkadeshan, learned counsel for the petitioner.
5. Mr.P.Sathish, learned Additional Government Pleader takes notice on behalf of the respondents.
6. Without going into the merits of the case, petitioner is directed to make an on-line application with necessary charges, within a period of one week from today. On such application is being made, the respondents shall survey the land, after issuing notice to the petitioner and the neighbouring land owners, within a period of two months thereafter.
7. With the above direction, this writ petition is disposed of, at the admission stage itself. No costs 2/2/2023 Index : Yes / No Internet: Yes Speaking/non speaking order mvs.
