Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to conduct an enquiry in respect of Na.Ka.No.1092/Aa3/2022 dated 01.04.2022. ORDER
This writ petition is filed seeking for the issuance of Writ of Mandamus to direct the 1st respondent to conduct an enquiry in respect of Na.Ka.No.1092/Aa3/2022 dated 01.04.2022 to set right the mistake.
2. The case of the petitioner is that the petitioner is the absolute owner of the land in S.No.65-2B measuring an extent of 1 acre and 11 cents. It is the grievance of the writ petitioner that the said survey number was wrongly included in the third respondent's property without any sufficient documents. Hence, the petitioner made a representation to the first respondent to set right the wrongful entry, on 05.01.2022 and the first respondent gave a direction in Na.Ka.No.1092/A3/2022 dated 01.04.2022 for further enquiry, however, the same is pending without consideration. Hence, this writ petition.
3. When the case was taken up, the learned counsel for the petitioner was posed several questions, whereas, this petitioner admitted that there is no sale deed executed in respect of the survey number.
4. Such being the position, seeking directions to the District Registrar/first respondent to set right the discrepancy in the revenue records does not arise at all. If at all, there is any grievances for wrongful entry in the 2/4
revenue records, the petitioner's remedy lies somewhere else. The petitioner has to approach the concerned revenue authorities not before the District Registrar/first respondent.
5. Such view of the matter, this writ petition stands dismissed with a liberty to the petitioner to approach the concerned revenue authorities. No costs.
