ORDER

This petition had been filed to call for the records related to the case in C.C.No.791 of 2018, on the file of the learned Fast Track Magistrate Level Court, Ambattur and quash the same, as against the Petitioner/third Accused.

2. When the case came up for previous hearing, there was no representation for the Petitioner though the case was listed under the caption "for dismissal." The case was finally taken up for hearing on 06.04.2022. At that time also, there was no representation for the Petitioner. Therefore, the case was passed over to 3.30 P.M. When the case was again taken at 3.30 P.M., there was no representation for the Petitioner. Therefore, interim stay was not extended.

3. In view of the above, this petition is dismissed with the direction to the learned Judicial Magistrate to proceed with the trial and dispose of the same within a period of three months. If the Accused is absconding and warrant is pending before the learned Judicial Magistrate, he shall execute the warrant. If the Accused is produced on warrant, he shall be detained in Prison to proceed with the trial upto the stage of pronouncement of judgment. Till such time the accused if had been absconding and produced on warrant shall be detained in prison. Consequently, connected Miscellaneous Petition is closed.
