ORDER

The case has been heard through video conference The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 4 (1)(a), 4(1-A) of TN Prohibition Act r/w 420, 468, 471 of IPC, in Crime No.121 of 2021, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the petitioners had transported 16 bottles of Pondy liquor by using India car bearing Registration No.TN 31 AB 7225 without any valid permission. Hence, the complaint was registered.

3.The learned counsel for the petitioner would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4.The learned Additional Public Prosecutor submits that the petitioners had transported 16 bottles of Pondy liquor by using India https://hcservices.ecourts.gov.in/hcservices/

car bearing Registration No.TN 31 AB 7225 without any valid permission. He would further submit that the entire contraband has been seized by the respondent police. He would further submit that there is one previous case pending as against the petitioners. Hence he vehemently opposed to grant of anticipatory bail to the petitioners. 5.Taking into consideration the facts and circumstances of the case and that the petitioners have involved in very serious offence and there is one previous case pending as against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 17/02/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
