O R D E R

This petition is filed by the petitioner seeking to withdraw the H.M.O.P.No.4484 of 2018 pending on the file of V Additional Family Court, Chennai and to transfer the same to Family Court at Trichy.

2. The learned counsel for the petitioner submits that he was set exparte on 10.01.2019 and that he filed a Transfer Civil Miscellaneous Petition only on 29.01.2019. As on date he is not a party to any proceedings. As such, the Transfer Civil Miscellaneous Petition is not maintainable.

3. It is open to the petitioner to approach this Court after restoring the case on file.

4.The Transfer Civil Miscellaneous Petition is disposed of with the above liberty. Accordingly, connected Civil Miscellaneous Petition is closed.
