Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ, order or direction or any other appropriate writ, in the nature of Writ of Mandamus, directing the first respondent to take appropriate action based on the representation of the petitioner dated 19.04.2019 and in pursuance of the communication of the second respondent dated 10.09.2019 made in Na.Ka.No.R-3/G.P./1502/2019 to the first respondent forthwith and to remove the fourth respondent from the service as he has obtained the appointment order by playing fraud and impersonation.

ORDER

This Writ Petition has been filed for the issuance of direction to the first respondent to take action based on the representation made by the petitioner on 19.04.2019 and to remove the fourth respondent from service on the ground that he has obtained the appointment by playing fraud.

2. The learned Special Government Pleader appearing on behalf of the respondents submitted that the petitioner had, on an earlier occasion, filed a Writ Petition with a similar prayer and the Writ Petition was dismissed as withdrawn on 13.09.2019. By concealing this fact, the present Writ Petition has been filed before this Court.

3. The learned counsel appearing for the petitioner submitted that the petitioner did not inform him regarding the filing of the earlier Writ Petition and, therefore, he is not aware about the dismissal of the earlier Writ Petition.

4. The petitioner has approached this Court with unclean hands and the present Writ Petition has to be dismissed on that sole ground. What the petitioner was not able to achieve in the earlier Writ Petition, has now been sought to be achieved by changing the counsel and couching the relief in a different way.
