PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent not to harass the petitioner and her husband in connection with Crime No.95 of 2019 on the file of the Respondent.

O R D E R

This petition has been filed to direct the respondent not to harass the petitioner and her husband in connection with Crime No.95 of 2019 on the file of the Respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioner has submitted that the petitioner is the owner of a Car namely, Ford with registration No. TN-48-AC-1823. He further submitted that the petitioner has not involved in any accident so far, but the petitioner received a call from the respondent police station asking herself and her husband to come to the police station for enquiry in connection with an FIR registered on 10.02.2019 in Crime No. 95 of 2019 and therefore he requests to direct the respondent not to harass the petitioner.

4. Per contra, the learned Additional Public Prosecutor appearing for the respondent has submitted that after registering the FIR in Crime No. 95 of 2019 under Sections 279 and 337 of IPC, the respondent has taken the matter for https://hcservices.ecourts.gov.in/hcservices/

investigation and during the investigation, it was found that Eco Fort car bearing registration No. TN-48-AC-1873 has been involved in the said accident and that the injured subsequently died and hence, the case was altered into under Sections 279, 304 (A) of IPC. He further submitted that on verification it was found that the aforesaid car belongs to the petitioner herein and hence the petitioner was called for enquiry in the aforesaid crime and also directed to produce the vehicle for Motor Vehicle Inspector's inspection but she immediately rushed to this Court and filed this petition. He further submitted that the vehicle bearing registration No.TN-48 AC-1823 relating to TVS Scooty and the petitioner has purposely given wrong number in her petition and therefore he prayed to dismiss the petition.

Considering the submissions of the learned Additional Public Prosecutor that the petitioner's car is bearing registration No. TN-48-AC-1873 only and not TN-48-AC-1823 and that since investigation reveals that the petitioner's car is involved in crime No.95 of 2019, the petitioner has to produce her car before the Investigation Officer for investigation purpose and instead of that she should not come to this court by saying the respondent is harassing.
