ORDER
This writ petition has been filed for direction directing the respondents to appoint the petitioner temporarily as conductor based upon the conductor license obtained by the petitioner dated 11.12.2023 in R.No.25538/B3/2023, RTO, Mettur, Salem District subject to seniority maintained in the matter of compassionate appointment as stated in the order in W.P.No.6922 of 2018 dated 26.03.2018 on the file of this Hon'ble Court.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner's father was working as a Conductor under the respondent Corporation and died due to cardiac arrest on 25.10.2015 at the age of 49. He died leaving behind the petitioner, his mother and his grand mother and daughter. Immediately, after the demise of his father, the petitioner made an application seeking appointment on compassionate ground, annexing all the relevant records. However, it was not considered and as such, the petitioner was
constrained to approach this Court in W.P.No.6922 of 2019. This Court, by an order dated 26.03.2018, directed the respondents to consider the representation submitted by the petitioner subject to the seniority maintained in the matter of compassionate appointment and pass orders, within a period of four weeks from the date of receipt of the order. However, even till today, the request made by the petitioner is not considered and it is still pending. In the meanwhile, the petitioner also obtained Conductor license, on 11.12.2023 from the Road Transport Officer, Mettur, Salem.
4. Considering the above, the respondents are directed to consider the request made by the petitioner based on the conductor license obtained by him and appoint the petitioner in a suitable post subject to the seniority, within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
