Order : These petitions coming on this day for hearing upon perusing the petitions and the affidavits filed in support thereof and upon hearing the arguments of MR.R.SHANMUGHASUNDARAM, Advocate General assisted by MR.S.JOHN.J.RAJA SINGH, Government Advocate for the petitioners and of MR.KARTHIK SESHADRI for M/S.IYER & THOMAS, Advocate for the respondent, the court made the following order:- [Order of the Court was made by M.M.SUNDRESH, J.] Though earlier orders directing the petitioners to deposit the amount has not been complied with, in view of the submission made by the learned Advocate General that money is ready now to be deposited, we are inclined to permit the petitioners to do so. the earlier order, a sum of Rs.7,50,00,000/- was directed to be deposited.
2. Since the said order is one of deposit, it was not complied with on two occasions coupled with the fact that the decree amount along with interest would come to Rs.25 crores, we are inclined to make the stay absolute by directing the appellants/petitioners to make the said payment to the respondent subject to the result of the appeal within a period of two weeks from the date of receipt of a copy of this order. We feel that the said order will satisfy both sides as it is only an interim arrangement and there cannot be any exparte order of stay of the decree which was accordingly granted on contest.
This miscellaneous petition is disposed of accordingly. Registry is directed to list the appeal for final hearing on 25.10.2021.
