Respondents Prayers: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, to call for the records in relating to the Na.Ka.ThaA.1/37/2015 dated 15.06.2016 passed by the 4th respondent and quash the same and consequently direct the 1st respondent herein to grant permission based on the petitioner's application dated 06.06.2016 and 10.05.2017.

O R D E R

Mr.S.Gunasekaran, the learned Standing Counsel takes notice for the respondents 1 and 4 and Mr.D.Suriyanarayenan, the learned Additional Government Pleader takes notice for the respondents 2 and 3. By consent of the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed seeking for issuance of Writ of Certiorarified Mandamus, to quash the order of the fourth respondent passed in Na.Ka.ThaA.1/37/2015, dated 15.06.2016 and for a direction to the first respondent to grant permission based on the applications of the petitioner dated 06.06.2016 and 10.05.2017.

3. The case of the petitioner is that, he is a Local Cable TV Operator and the licence of the petitioner was cancelled by the fourth respondent on 15.06.2016.

4. The learned counsel for the petitioner submitted that the fourth respondent is only a recommending authority and he has no power to cancel the licence of the petitioner.

5. The learned Standing Counsel appearing for the respondents 1 and 4 submitted that the petitioner has submitted a fresh application to the first respondent on 10.05.2017 and the first respondent has call for the report from the fourth respondent and appropriate orders will be passed on the application of the petitioner.

6. In the light of the above submissions, this Court directs the first respondent to pass orders on the application of the petitioner dated 10.05.2017 on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order, after providing an opportunity to all necessary parties.

7. With the above direction, this Writ Petition is disposed of. No Costs. Consequently, connected miscellaneous petitions are closed.
