M/S.Futuregenerali India Ins v. R.Angel(Minor)

Lok Adalat - II C.M.A. No.597 of 2015 T.N. VALLINAYAGAM .J (Retd) "On being mentioned" the case has come before this Forum today.

2. At the time of passing of the award in this case, the claimant was a minor, born on 25.11.2000. At request of the parents of the claimant, a sum of Rs.10,00,000/- (Ten Lakhs Only) was deposited in the Indian Bank, Kilpauk, Chennai out of total award amount of Rs.30,00,000/- for the purpose of education of claimant and treatment of numerous injuries and balance amount became payable to the minor on or before 25.11.2018 on attaining major of the Claimant.

3. Today, the father Mr. Ramamoorthy and the mother Mrs.Bagiyarathi of the claimant are present before the Forum and has filed a memo enclosing the birth certificate of their daughter stating that since their daughter/the minor claimant attained major on 15.08.2018, the balance amount may be permitted to withdraw from the Bank.

4. In view of the above, the bank is directed to allow the http://www.judis.nic.in claimant to withdraw the balance amount deposited in M.C.O.P. No.3830

T.N. VALLINAYAGAM .J (Retd) lbm of 2010, since the claimant, Ms.R.Angel has attained majority on 15.08.2018, with interest as per the terms stated in the award passed on 06.04.2017 by this Forum.

5. Accordingly, the memo is ordered.
