ORDER

Today when the matter came up for hearing, the petitioner side not present.

2. The learned counsel appearing for the respondent would submit that the petitioner was originally allotted Plot No.13 in the SIDCO Industrial Estate, Theni and since she did not put the same into use, the allotment stood cancelled. While so, she was also claiming to allot the adjacent Plot No. 14, which was also not granted since Plot No.13 itself was not put into use by the petitioner. Aggrieved by the non allotment, this writ petition is filed in

3. Pending the writ petition, the claim of the petitioner was rejected and the EMD amount of Rs.10,000/- was refunded to the petitioner. Subsequently, the said Plot No. 14 was allotted to third party namely Mr.M. Amarnath by order dated 22.01.2004. There has been subsequent proceedings in respect of Amarnath also.

4. In view of the subsequent developments, the original prayer to allot the Plot No. 14 cannot be countenanced at this stage and the prayer made in the writ petition has already become infructuous.

5. Accordingly, the writ petition is disposed of having become infructuous. No Costs.
