in S.A.No.671 of 2019 M.SUNDAR., J Mr.C.Harish, learned counsel representing the counsel on record for petitioners and Mr.S.S.Raghavan, learned counsel for respondents are before this virtual Court.
2. Plaintiffs in the trial Court are the appellants in the main Second Appeal. Pending main Second Appeal first appellant [Gajji Gowdu, S/o.Beeru Gowdu] died and this Court is informed that the date of demise is 28.08.2020. This has necessitated the captioned 'Civil Miscellaneous Petition' ['CMP' for the sake of brevity] with a prayer to bring on record the legal heirs of the deceased fist appellant. This Court is informed that the deceased first appellant's wife is already on record as second appellant and his other legal heirs are to be brought on record as appellants 3 to 6.
3. Learned counsel for respondents submits that he has no opposition or objection to captioned CMP being allowed.
4. This Court, having heard learned counsel on both sides, having perused the affidavit filed in support of captioned CMP, having been 1/3
satisfied that the prayer in the captioned CMP is not only innocuous, but imperative for carrying the captioned main Second Appeal to its logical end, is of the view that prayer in the captioned CMP deserves to be acceded to.
5. In the result, CMP ordered as prayed for. Registry to carry out necessary, consequential amendments in the case file within three(3) weeks from today i.e., on or before 30.07.2021. There shall be no order as to costs. 09.07.2021 (1/3) kmi 2/3
