PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Declaration to declare that dis-qualifying the petitioner without allowing participation in the interview conducted on 17.06.2005 and selecting the 3rd respondent for award of retail outlet dealership at Thirunelveli, Ponagudi is illegal and consequently, direct the 1st respondent to conduct the interview allowing participation of the petitioner and select him for award of retail outlet dealership at Thirunelveli, Ponagudi.

O R D E R

Heard, Mr.S.Elamurugan, learned counsel for the petitioner and Mr.K.Ethiraj learned counsel for the respondents 1 and 2. 2.The grievance of the petitioner is that he was disqualified and not allowed to participate in the interview conducted/held on 17.06.2005 for awarding 'All Retailer Outlet Dealership' at Thirunelveli, Ponagudi.

3.Today when the matter called for, the learned standing counsel for the respondents 1 and 2 submitted that pending disposal of the Writ Petition, the Retail outlet was granted in favour of the third respondent in the name and style of 'Thirupathi Fuel' and the Retail Outlet is also functioned from 2005 on wards. At this belated stage, it would not be appropriate for this Court to consider the prayer sought for by the petitioner and disturb the Retail Outlet, which is now being run by the third respondent for more than 13 years. Hence the Writ Petition stands dismissed. Consequently, connected Miscellaneous Petition is closed. No Costs.
