These petitions are filed to i) condone the delay of 828 days in filing the petition to set aside the abatement, ii) set aside the abatement caused due to the death of the 2nd appellant and iii) bring on record the legal representatives of the deceased second appellant namely M.Arumugam.

3. Mr.N.Manokaran, learned counsel for the first respondent has no serious objection for allowing this petition. R2 to R6 has already been given up.

4. Taking into consideration the reasons stated in the supporting affidavit and the legal heirship certificate produced, this Court is satisfied that sufficient cause has been made out for condoning the delay and the proposed parties are the legal heirs of the deceased second respondent.

5. Accordingly, the delay is condoned. The abatement is set aside. Third petitioner namely, A.Rajamanickam is impleaded as the legal heir of the deceased second appellant.

6. These Civil Miscellaneous petitions are allowed. No costs. Registry to carry out the necessary amendments.
