O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 189(2), 329(3), 115(2), 118(1), 303(2) and 351(3) of BNS, 2023, in Crime No.334 of 2025 on the file of the respondent Police, seeks anticipatory bail. 1/4

The allegation against this petitioner is that due to a money dispute, the petitioners trespassed into the defacto complainant godown along with the other accused and threatened him with dire consequences and assaulted with hands and knife, due to which, he sustained injuries. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner. 4.

The learned counsel appearing for the intervenor raised strong objection for the grant of anticipatory bail to the petitioner by stating that, the petitioner joined hands with other accused and assaulted the complainant using knife. The petitioner has 11 previous cases against him and he is the main accused in this case.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner 2/4

reiterated the prosecution case and submitted that the petitioner along with the other accused attacked the complainant using knife, due to which, he sustained injuries; that the investigation of this case is pending and there are 11 previous cases.

Considering the facts and circumstances of this case, gravity of offence, the petitioner and other accused had actively participated in assualt and taking note of the fact that the investigation of the case is pending and bad antecedents of accused, this Court is not inclined to grant anticipatory bail to the petitioner.
