This Writ Petition has been filed for direction directing the respondent to return the following items, i. Oil Cake Blended Hydrocarbon Oil with a capacity of above 23,000 litres. ii) TANKER - MAHINDRA Tanker Lorry (12 wheels) with Registration Number TN 18 AT 8103. iii) TANKER - BHARAT BENZ TANKER LORRY (12 wheels) with Registration Number TN 18 AM 8074. iv) TANKER - TATA Mini Tanker Lorry (4 wheels) with Registration Number TN43 Z 4777.
2. Heard both sides and perused the materials available on record.
3. On instructions, the learned Government Advocate (Crl.side) for the respondent would submit that the properties which were sought for return are already confiscated by an order dated 24.06.2024.
4. In view of the above, the direction sought for in this petition cannot be considered. However, the petitioner is at liberty to challenge the confiscation order in the manner known to law.
5. Accordingly, this writ petition stands dismissed. No costs.
