Respondent PRAYER : Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the Respondent herein to enable the petitioner trust to submit its application online in the web-portal maintained by the respondent and accord concurrence for its building of the Educational Institution viz., McGan's Ooty School of Architecture in pursuance to G.O. (Ms.) No.76 dated 14.06.2018 issued by the Housing and Urban Development [UD4 (3)] Department.

O R D E R

1. The Writ Petition has been posted under the caption "being mentioned" today and the Writ Petition has been filed seeking for a direction to the respondent permitting the petitioner trust to submit their application for building permission through online as per the G.O.Ms.No.76, Housing and Urban Development [UD4 (3)] Department, dated 14.06.2018.

2. Wherein in para 2 of the order, it is stated that the petitioner trust is proposed to construct the building for the educational institution and for that purpose, they have made application. In fact, the petitioner has already constructed the building and they are seeking the relief as per G.O.Ms.No.76, Housing and Urban Development [UD4 (3)] Department, dated 14.06.2018, but in the order, it was wrongly mentioned that the petitioner has proposed to construct a building and hence, for correcting the said order, now the Writ Petition is posted today.

3. Considering the facts, the Registry is directed to issue a fresh order as follows :- "According to the petitioner, the petitioner Trust has already constructed a building for their educational institution at Ooty, Nilgiris District" instead of "the petitioner trust proposed to construct a building for their educational institution at Ooty, Nilgiris District."
