Criminal Original Petition filed under Section 528 of BNSS, 2023, seeking to direct the 3rd respondent, Deputy Superintendent of Police, Land Grabbing Cell, Krishnagiri, not to harass the petitioner by appreciating the facts and circumstances of the case.

ORDER
This criminal original petition has been filed seeking to direct the respondents not to harass the petitioner under the guise of enquiry.
2. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondents, on instructions, submitted that based on the complaint given by the 4th respondent herein, current paper enquiry is pending in C.No.539/H2/SP-Grievance/DCB-II/ 2025 and the petitioner was called only for enquiry and that the respondentpolice are not unnecessarily harassing the petitioner.

In response, the learned counsel for the petitioner submitted that this is the third complaint given by the 4th respondent as against the petitioner on the very same set of facts and the earlier complaints filed by the 4th respondent have already been closed. However, without considering the same, the respondent-police are unnecessarily harassing the petitioner under the guise of enquiry.
4. In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and cooperate in the investigation. It is made clear that the petitioner shall not be harassed during the course of enquiry/investigation. If any cognizable offence is made out, the respondents shall register a First Information Report and proceed in accordance with law.
5. This criminal original petition stands disposed of accordingly. The respondent-police shall complete the enquiry/investigation within a period of four (4) weeks from the date of receipt of a copy of this order. It is made clear that the petitioner shall not be unnecessarily harassed. 06.02.2026 skt NCC : Yes/No To:
