This application has been filed by the applicant/debtor. The applicant/debtor was adjudicated as an insolvent on 13.04.2015. Thereafter, the applicant filed A.No.211 of 2017 to set aside the ex-parte order of the adjudication dated 13.04.2015, as the claim of the petitioning creditor/2nd respondent herein was settled. This Court was also pleased to allow the application on 21.07.2017 and was pleased to close the main petition in IP.No.15 of 2024. Hence, this application has now been filed for effecting paper publication.
2. The learned counsel for the petitioning creditor/2nd respondent herein submits that he has no objection for allowing this application.
3. The learned Official Assignee would submit that it is the petitioner who has to deposit the amount towards the publication in the official gazette in terms of Rule 17 of the Presidency Town and Insolvency Act, 1909 and the amount has to be deposited to the credit of the State Government.
4. The learned counsel for the applicant undertakes to pay the amount.
5. Accordingly, this Application stands disposed of by directing the applicant herein to pay the amount for publication in the Gazette with the State Government and the amount of publication with the Official Assignee. On such amount being deposited by the applicant, the publication will be effected by the Registry. 08.03.2024 jas
