Respondents PRAYER: Writ Petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorari, call for the records of the 1st respondent in Computation Petition No.239 of 2011 dated 08.03.2012 and to quash the gist order and order as illegal, by upholding the granting of monetary benefits for Rs.86,372/- as illegal and against the provisos of the Industrial Disputes Act, 1947.

The Writ Petition had been filed challenging the order dated 08.03.2012 passed in C.P.No.239 of 2011 filed by the 2nd respondent, based upon the award made in I.D.No.276 of 2003 dated 22.03.2010. 2.The grievance of the petitioner in this Writ Petition is that during the pendency of the lis as against the award made in the aforesaid ID, a Computation Petition has been filed and the same also ordered. 3.It is now brought to the notice of this Court that the challenge to the award was rejected in W.P.No.20507 of 2010 dated 15.09.2010 and against which the petitioner had preferred a Writ Appeal in W.A.No.4096 of 2019 and the same had also been dismissed on 05.03.2020. In such view that the award which had already been affirmed by the 1st Bench of this Court, I find no infirmity or illegality in the Computation Petition, as the same has been 2/4
filed on the basis of the award passed by the Labour Court in I.D.No.276 of 2003 dated 22.03.2010.
4.Since the order impugned in this Writ Petition is affirmed, there shall be a direction to the petitioner to disburse the amount as computed in the Computation Petition, within a period of eight (8) weeks from the date of receipt of a copy of this order.
5.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected miscellaneous petitions are closed.
