ORDER
The petitioner, who was arrested and remanded to judicial custody on 26.12.2025, for the offence punishable under Sections 420, 409, 120 B of IPC in Crime No.1 of 2024, registered on the file of the respondent, seeks bail.

The case of the prosecution is that this petitioner along with other accused conspired with each other and cheated the defacto complainant by giving false assurance that their company, in the name and style of Sri Sai Cars at Tambaram, would take his car on a monthly rental basis. Subsequently, the petitioner and other accused paid rent for three months, but thereafter, the accused persons evaded the payment and returned the cars thereby cheated several persons to the extent of several Crores. Further it is stated that the petitioner is ranked as A7, he was Accountant cum Manager and through his bank account Rs.1.81 Crores have been handled and the petitioner is also actively participated in this case. Hence, the complaint.

The learned counsel appearing for the petitioner submitted that all the arrested accused including the similarly placed accused have been granted bail by this Court in Crl.O.P.Nos.26355 of 2024, 23102 of 2025 and 22088 of 2025 dated 29.10.2024, 17.09.2025, and 12.09.2025 respectively. Further investigation is concluded and final report is also filed. Only after filing of the
final report a Non Bailable Warrant was obtained, the petitioner was arrested and is in custody and ready to cooperate with the trial. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that through the bank account of the petitioner Rs.1.81 crores have been transacted and so far A2 is the main accused who is still absconding and the money is not recovered. He further submitted that further investigation in this regard is also going on. The co-accused who were similarly placed were already granted bail, A1 who played a major role is also absconding. Further the petitioner's two more bank accounts are yet to be verified. Hence, he opposed the grant of bail to the petitioner.
5. I have gone through the FIR and other connected materials, it revealed that primary investigation is concluded and the final report is also filed. After obtaining a Non Bailable Warrant, this petitioner has been arrested and he is in custody from 26.12.2025. Further submitted that a huge amount of Rs.1.81 crores was transacted in only one account and two other accounts are yet to be verified and after thoroughly investigating the bank account, the further role of the petitioner would be revealed and so far no money is recovered, I am of the view that though co-accused were granted bail and they could not be considered as similarly placed accused along with other accused since other accused were
not involved in transacting the money, and the petitioner has played a major role and money has been transacted through his bank account, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
