This Writ Petition is filed challenging the order of the Tribunal granting salary to the first respondent herein, for the period 24.01.2008 till 20.11.2008, i.e. the date of his compulsory retirement.
2. The learned counsel for the petitioners fairly submits that despite best efforts put in by them, the whereabouts of the first respondent were not known and service could not be effected. He pleaded that the writ petition may be closed with liberty to file a fresh writ petition, as soon as the address of the first respondent is traced. Under such circumstances, no purpose would be served in keeping the
writ petition pending.
3. Therefore, the Writ Petition is dismissed. However, the writ petitioners are at liberty to file a fresh petition, as soon as the address of the first respondent is traced, who is stated to be compulsorily retired, now. No order as to costs. Consequently, the connected Miscellaneous Petition is closed.
