Respondent Prayer: Petition filed under Article 226 of Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order passed by the respondent herein in his proceedings C.No.2336/D1/2014, R.O.No.81/2020 dated 28.04.2020 placing the petitioner under suspension and the consequential order passed by the respondent herein in his proceedings C.No.2336/DE1/2014, R.O.No.82/2020 dated 29.04.2020 not allowing the petitioner to retire from service on attaining the age of superannuation and retained the petitioner in service and quash the same and consequently direct the respondent herein to treat the period of suspension from 14.08.2008 to 27.04.2020 as duty for all purposes with pay and allowance and direct the respondent herein to allow the petitioner to retire from service with effect from 30.04.2020 with all retirement benefits including interest. The petitioner has come forward with this writ petition challenging the order passed by the respondent herein in its proceedings in C.No.2336/D1/2014, R.O.No.81/2020 dated 28.04.2020 placing him under suspension and the consequential order passed by the respondent herein in its proceedings C.No.2336/DE1/2014, R.O.No.82/2020 dated 29.04.2020 not allowing him to retire from service on attaining the age of superannuation and retained him in service and consequently for a direction to the respondent herein to treat the period https://hcservices.ecourts.gov.in/hcservices/

of suspension from 14.08.2008 to 27.04.2020 as duty for all purposes with pay and allowance and direct the respondent herein to allow the petitioner to retire from service with effect from 30.04.2020 with all retirement benefits including interest.

2. When the matter is taken up for hearing Mr.Ravi Shanmugam, learned counsel appearing for the petitioner would submit that the representation given by the petitioner has been rejected and that the petitioner may be given liberty to challenge the said order.

3. Accordingly, the writ petition is disposed of with liberty as prayed for. It is open to the petitioner to raise all the grounds that are available to him including the one that has been taken in the present writ petition. No costs.
