ORDER

This criminal miscellaneous petition has been filed praying for direction to the learned District Munsif cum Judicial Magistrate

Court, Vanur, Villupuram District to ensure strict compliance with and give full effect to the order dated 04.01.2023 passed by this Court in Crl.OP.No.32602 of 2022 by forthwith completing the committal proceedings in PRC.No.7 of 2014 within a fresh and outer time limit to be fixed by this Court.

On perusal of records, it is found that this Court in Crl.OP.no.32602 of 2022 by order dated 04.01.2023, directed the aforesaid court to take effect steps to execute non bailable warrant pending against accused 6, 9, 10 & 11 to complete the committal proceedings in PRC.No.7 of 2014. This court specifically recorded that mere pendency of special leave petition before the Hon'ble Supreme Court of India in SLP.No.8875 of 2015 is not a ground for not committing the case, unless there was a stay of further proceedings. However, it was not complied with and as such, the petitioner had filed this miscellaneous petition to implement the order passed by this Court on 04.01.2023. As such, this Court directed the said court to submit a report in this regard. Now, the report has been received, whereby it is revealed that the entire records were sent to the Hon'ble Supreme Court of India in Crl.A.No.641 of 2017 and as such, the court below could not complete the committal proceedings.

In view of the above, District Munsif cum Judicial Magistrate Court, Vanur, Villupuram District is directed to complete the committal proceedings immediately after receipt of the entire records from the Hon'ble Supreme Court of India.

With the above direction, this criminal miscellaneous petition stands allowed.
