This Original Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 to appoint a Sole Arbitrator to partition the properties set out as Item 1 Schedule A (Dhanalakshmi Hr.Sec.School) of the Memorandum of Oral Family Arrangement dated 12.01.2009 and to direct the respondent to pay the cost of the proceedings.

2. Notice was ordered to the respondent in this petition on 29.04.2021. Even though service of notice has been effected and the name of the respondent is also printed in the cause list, the respondent has not chosen to appear either in person or through counsel.

3. Therefore, this Court has no other option except to order this petition. Accordingly, the Hon'ble Mr.Justice N.Authinathan, Judge (Retd.), High Court, Madras residing at No.37, A-Block, Lakshmi Nivas Apartments, Marshalls Road, Egmore, Chennai - 600 008 (Cell No.9443084123) be and is hereby appointed as the Sole Arbitrator in https://www.mhc.tn.gov.in/judis/

Vsi accordance with Clause XVII of the Memorandum of Oral Family Arrangement dated 12.01.2009 to adjudicate the dispute inter se between the parties.

4. The learned Arbitrator appointed herein, after issuing notice to the parties and upon hearing them, pass an award preferably within a period of four months from the date of receipt of this order. The learned Arbitrator appointed herein, shall be at liberty to fix his remuneration and other incidental expenses. Both parties hereto shall bear their own costs.
