K. Subramanian v. Mrs Kasambu

C.M.P.Nos.3658, 3659 & 3664 of 2020 C.M.P.Nos.3658, 3659 & 3664 of 2020 in S.A.No.1119 of 2009 KRISHNAN RAMASAMY, J., C.M.P.No.3658 of 2020 has been filed to condone the delay of 1899 days in setting aside abatement caused due to the death of the sole respondent, namely Kasambu @ Baby Ammal.

2. C.M.P.No.3659 of 2020 has been filed to set aside abatement caused due to the death of the sole respondent, namely Kasambu @ Baby Ammal.

3. C.M.P.No.3664 of 2020 has been filed to bring on record the proposed respondents 2 to 6 herein as legal representatives of deceased sole respondent, namely Kasambu @ Baby Ammal and array them as respondents 2 to 6 in the above Second Appeal.

4. Heard the learned counsel appearing for the petitioner.

5. The learned counsel for the respondents 2 to 6 submitted that he has no objection for ordering these petitions.

6. Being satisfied with the reasons stated in the affidavit filed in support of these petitions, in C.M.P.Nos.3658, 3659 & 3664 of 2020 are ordered.

7. Registry is directed to carry out necessary amendment in S.A.No.1119 of 2009 within the period of two weeks and post the matter on 30.01.2023.
